Arbitration Rules and Forum:

For Users in the USA: The arbitration shall be conducted by the American Arbitration Association (AAA) under its rules and procedures, including the AAA's Consumer Arbitration Rules, or by any other arbitration service that both parties agree upon. The arbitration shall be held in Nevada, USA, or another mutually agreed location.For Users Outside the USA: The arbitration shall be conducted by a reputable international arbitration institution, such as the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA), or any other similar institution agreed upon by both parties. The arbitration shall be held in a neutral location that is mutually agreed upon, or if no agreement can be reached, the arbitration will occur remotely via video conference.B. Authority of Arbitrator: The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement. The arbitrator will decide the rights and liabilities, if any, of you and TJS Analytics LLC. The arbitration proceeding will not be consolidated with any other matters or joined with any other cases or parties.C. Waiver of Jury Trial: You and TJS Analytics LLC hereby waive any constitutional and statutory rights to go to court and have a trial in front of a judge or jury.D. Class Action Waiver: You and TJS Analytics LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.E. Final and Binding Decision: The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.F. Governing Law: The arbitration will be governed by the laws of the State of Nevada, USA, without regard to its conflict of law principles, except as otherwise required by the law of your jurisdiction.G. Language: The arbitration shall be conducted in English. If translation services are required, the costs shall be borne by the requesting party unless otherwise agreed by both parties.H. Costs: Each party shall be responsible for their own legal fees and costs of arbitration, except as otherwise required by the applicable arbitration rules or as determined by the arbitrator.

10. Force Majeure

The service will not be liable for failing to perform under these terms of use by the occurrence of any event beyond its reasonable control, including, without limitation, a labor disturbance, an Internet outage or interruption of service, a communications outage, failure by a service provider to the service to perform, fire, terrorism, natural disaster, or war.

11. Additional Terms of Service for Subscribers

Individual Subscription:

This subscription is for individual use only. You are not permitted to share your password with others. Swishinfo.ai reserves the right to limit access for each subscriber to a fixed number of physical locations, devices, or simultaneous logins.

Subscription Fees:

By subscribing, you agree to the following payment terms:

A $7 trial for the first 7 days of service, after which the subscription will automatically renew at $97 per month.The subscription will continue to renew automatically on a monthly basis unless canceled by you. You can cancel your subscription at any time through your account settings.C. Non-Refundable Fees: All subscription fees are non-refundable. Swishinfo.ai reserves the right to modify the content offered through the service at any time. Temporary price reductions or promotional offers do not entitle you to a refund if you are already subscribed under different terms.
